The National Diving & Activity Centre Limited (NDAC Ltd) is the supplier of the activity FearFest-Evil that appears on this website. When you purchase an “Activity” or book with a voucher from the NDAC Ltd or with a voucher provided by an external provider you become legally bound by these Terms & Conditions.

Please do not book for this “Activity” or complete a booking until you have read, understood and accepted these T&C’s in the first instance. These Booking T&C’s apply to the booking of FearFest-Evil and its activities you will also include any ancillary products that are associated to NDAC Ltd own T&C’s of Commercial Business Engagement.

These booking T&C’s contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you accept these terms and conditions of behalf of the group you are booking for and shall ensure that all members of your party are aware of and accept these Booking T&C’s.

At no point shall any variation to these Booking T&C’s be binding unless agreed in writing and in advance in the form of a Specific Event Agreement (SEA) in writing by NDAC Ltd and or its service providers. Any typographical clerical or other error or omission in any booking confirmation or other associated documentation issued by NDAC Ltd (including any electronic documentation, emails, printed literature or SMS text) shall also be subject to correction without any liability on the part of NDAC Ltd.

NDAC Ltd will always reserve the right to make changes to the “Activities” and FearFest-Evil whether to conform to any applicable safety or other statutory industry requirements or otherwise at short notice or offer an alternative experience. NDAC Ltd will also conform to all regulations and standard amendments (best practice) from other industry members.

No booking shall be deemed to have been accepted unless accepted in writing by NDAC Ltd (which shall include our email confirmation of booking if booked via our on line booking system). These Booking T&C’s incorporate our Privacy Policy, and assumption of Risk and Release of Claims alongside our Rules of Participation to include accepting the terms and conditions as lead booker, on behalf of the group or people within your group booking.

NDAC Ltd shall use its commercially reasonable efforts to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time for the “Activity”.

Prices

Subject to any terms agreed to in writing between NDAC Ltd and you, our standard charges and fees shall be calculated at our current rates and full payment shall be due at the time of booking along with any specific offers. Any discounted and promotional codes must be given and used at the time of booking. In the event of an order being placed against an accidental incorrect price, we will endeavour to inform the purchaser of the error within 10 days of the purchase being made. We will allow the purchaser to either cancel the booking or choose to pay the additional difference in price. Vouchers and purchases from external voucher providers may vary, NDAC Ltd shall not be held responsible for purchases or the prices displayed on external websites and other on line platforms. If you are in any doubt please contact the centre to discuss your concerns in the first instance.

Arrival, Admission & Allocation of Slots

FearFest-Evil opens at 6:30pm and last entry to the Scare Zones is strictly 10:30pm. We have no allocated time slots, we are operating queuing system, but you must enter within the opening and closing times of the event please be prepared to Queue. The queuing area is unsheltered, so you may want to bring an umbrella. You should arrive 1 hour before your intended entry to allow for parking, queuing, registration and transition around the site.

Drivers need to follow parking controls and restrictions from NDAC staff upon arrival at the site.

The car parking configuration may change due to numbers of visitors for each slot so please seek advice from NDAC staff upon arrival as to where best to park.

Site staff who work for, or sub-contract to, NDAC Ltd, who are on duty during the event, have the right to refuse admission to any member of the public who is causing a distraction to either site staff or other members of the public (no refund shall be issued).

We urge you to treat your booking as you would to catch a flight or train. If you arrive after 9.30 pm we cannot guarantee entry to the scare zones. The organisers will endeavour to fit in any late arrivals where possible but cannot guarantee this. We have a time schedule which must be adhered to. Anyone who is refused entry for late arrivals, will loose their booking no refund, exchange or substitution.

Only customers with a valid and in-date ticket will be allowed entry to the event. You are also responsible to check that no omissions have been made to your ticket prior to arrival, any issues please contact the office in advance to discuss.

Online ticket purchasing

All tickets purchased online or otherwise have been sold/bought as per the event fee, and are per person. From time to time we may offer some promotional discounted rates which would not apply if you have already purchased your tickets.

Any discounted rates cannot be used in conjunction with any other offer from NDAC Ltd.

You will receive your booking confirmation via email. The email contains a PDF, you will be required to print a copy and bring with you to your event slot, as proof of purchase. Once you have received your confirmation email, you cannot exchange, have a refund, unless its within the 14 day change of mind purchase period or sell on your tickets onto a third party – they are non transferable or refundable.

Ticket use is subject to our standard terms and conditions.

Discount Codes

Discount codes are issued subject to availability and can be withdrawn without notice at any time. NDAC Ltd reserves the right to stop such codes being used against specific products or events. Only one discount code can be used per booking. Discount codes cannot be applied retrospectively to previous bookings.

Weather

FearFest-Evil is primarily an outdoor event which will go ahead in all weathers. There is cover in the House of Horrors, the Water View Marquee and View Cafe Bar, but the rest of the event areas are generally outdoors and unsheltered. Please ensure you are dressed in warm outdoor clothing, umbrella and sturdy footwear appropriate to the conditions and time of year.

Wear old clothes, as they may get ruined and covered in paranormal fluid, Any damage to clothing is not the responsibility of Fear Fest-Evil.

Our “Activities” (Zip Slide ) are weather dependent. Please be aware that the weather can be unpredictable and activities occasionally have to be cancelled because of this. High winds, lighting and thunderstorms are our main concerns. Cancelling an activity can be a huge inconvenience, however your safety is paramount and we would appreciate your understanding.

Please make sure you have provided us with all your contact details and include the mobile phone number you will have with you on the day.

If your “Activity” is cancelled due to weather conditions we will endeavour to reschedule it as soon as possible. No refunds will be given. You will automatically receive a new activity code voucher so you can re book your activity on a more suitable date. The new voucher will be like for like but may mean your activity is then completed in daylight hours. We cannot guarantee that a particular date will not be withdrawn due to further adverse weather conditions.

Non attendance on a day will see you lose your “Activity”. In the event of cancellation, NDAC Ltd will not be held liable for any costs of lost insurance premiums, travel expenses, pre-booked accommodation costs, bridge fees or any other costs incurred.

Descriptions & Images

All descriptions contained on our website and in our marketing material for FearFest-Evil are correct at the time of going to press. Descriptions may be updated or amended throughout the year and the “Activity” may be liable to change. The images used in all promotional literature to illustrate “Activities or events”, are used as an indication only. NDAC Ltd shall not be responsible for the descriptions and images of external websites and online platforms or “gift companies” in any instance. Any person who takes part in our activities or events who does not wish to appear in any of our promotional imagery or photography must inform NDAC Ltd in the first instance.

Refunds & Cancellations

If you change your mind about your purchase, NDAC Ltd will refund bookings and vouchers bought directly from the NDAC Ltd within 14 days of purchase, minus a £5.00 administration fee. After 14 days all tickets that have been purchased shall not be refunded transferred or exchanged for any cash, activity or service.

NDAC Ltd shall operate the advertised programme however if circumstances beyond our control arise we may have to amend the experience.

If NDAC Ltd have to cancel any event slots, we will endeavour to offer you an alternative slot, if this cannot be achieved, then a full or partial refund can be considered. Payments made by debit card or credit card will be refunded to the same card. Where gift vouchers have been bought from external providers and a booking has been made, no refunds will be given and voucher validity will be lost for any cancellations.

Should you need to cancel a booking you have already made, no refunds will be given and voucher validity will be lost.

For participants failing to turn up to an event you will not be able to reschedule bookings, no refunds will be given and voucher validity will be lost.

Sometimes the NDAC Ltd may have to cancel activities for reasons, such as the weather or mechanical breakdown, or because minimum requirements are not met such as a minimum group of people. We regret that such eventualities but in these circumstances, NDAC Ltd is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled activity.

An activity may be terminated without warning during the lifetime of vouchers and bookings on these occasions an equivalent or alternative location or activity will be offered. If this is not suitable credit will be offered but no cash refunds will be made.

Corporate & Group Bookings

Corporate and Group Bookings are treated the same as individuals unless a separate Specific Event Agreement (SEA) is in place in this instance please consult your contract for information. In the event your booking is made via NDAC Ltd Booking Contract these Booking Terms and Conditions shall be subject to any special terms set out in the Group Booking Contract.

If you are booking a number of tickets for a group, the individual making the booking accepts our terms & conditions, rules & restrictions on behalf of their group.

Insurance

The very nature of some of the “Activities” that we promote means that some are considered dangerous. Prior to ordering or participating in any experience you should be aware of the risks involved. NDAC Ltd can provide further information if you are in any doubt about any experience. We hold valid public liability insurance.

Venue Liability

NDAC Ltd will not be responsible for and damage or loss of possessions. Your car is also subject to this none liability while you are on site this also applies to anything of value you may have with you, or left in your vehicle or around NDAC venue.

NDAC Ltd except as otherwise provided in these Booking Terms and Conditions shall not be responsible for the loss, or damage, of or to any property or to person arising from the booking of or participation in the Event. NDAC Ltd shall not be responsible for the actions and quality of external providers or any loss or damage suffered by you whilst you are attending one of our Events.

By participating in an Event with us you acknowledge that certain factors are beyond the control of NDAC Ltd and agree that neither NDAC Ltd shall be liable for the cancellation, postponement or alteration of any activity for reasons beyond its reasonable control including for weather-related reasons, mechanical failure or otherwise. In the event of mechanical machinery break down you should expect reasonable substitutions without notice.

The total liability of NDAC Ltd for any claim whatsoever in connection with the Event or voucher or any course or experience shall be limited to the price paid for the voucher or booking.

Personal Belongings

It is the participant’s responsibility to ensure that they are in possession of their personal belongings following their experience. NDAC Ltd has no liability to compensate or offer replacements for items lost at one of our Events.

Merchandise

All merchandise is provided at an additional charge and is in no way linked to the price of your experience. Prices of merchandise may vary throughout the year. Where specific elements are not available, we reserve the right to make reasonable substitutions on the day. If this is not possible we reserve the right to cancel merchandise at short notice.

Behaviour

Please respect our neighbours and show consideration for local residents whilst travelling to and from the site and taking part in activities at the National Diving & Activity Centre.

Unbecoming behaviour at any time during the event, to any of our staff or other members of the public, will not be tolerated and any individual who, in our opinion, has breached this restriction shall be asked to leave site with immediate effect (no refund shall be given). Physical and verbal abuse shall not be tolerated and any breach of these rules will result in you not being able you access to any of the Scare Zones or your removal from the scare zones  (no refund will be given).

Spectators

Spectators are permitted in the View Cafe Bar, but no access will be permitted to the Scare Zones or the Water View Marquee.

CCTV

CCTV is in operation throughout the Centre 24 hours a day and monitored for the purposes of crime prevention and public safety. This scheme is controlled by Chubb Fire and Security. For further information please contact Chubb on 0844 879 1738.

Restrictions

It is the purchaser’s responsibility to ensure that the age and health restrictions are met. Once you have confirmed a booking you are not eligible for a refund if you are forced to cancel because the minimum requirements are not met. Details of restrictions and requirements are below. Please read them carefully.

If you are not in good health you should NOT participate.

The night creatures will touch you, grab you, taunt, capture and even tie you up, they may blindfold you or separate you from your group or partner. If you’re really lucky you might get covered in paranormal fluid in preparation of feeding you to the ancient evil so be warned wear old clothes as they may get ruined. (all products or fluids used, are skin safe, toxin and allergen-free) Please be prepared for the night creatures to interact like never before and immerse you in the terror of the underworld. We cannot guarantee you will not be harmed, due to the nature of the event, if you are grabbed, captured or sprayed do not retaliate. If you want the night creatures to let you go. Say safe word: Condemned

Do not book if you are not prepared for this personal interaction.

FearFest-Evil is set around a disused railway line, with uneven and muddy ground. Visitors must be able to walk un-aided and have good levels of health and fitness to take part in this event. We regret that due to the nature of this event wheelchair access is not possible. You must advise us immediately after booking if you have someone in your group with any access issues and we will liaise with you to assess if their visit is feasible.

Due to the nature of this scare event we strongly recommend that you are fully fit and healthy. The event does involve walking on uneven surfaces and muddy embankments, sudden noises, special effects and enclosed spaces. Only attend if you think you’re fit and healthy enough.

Do not book if any of these conditions apply to you:

PREGNANT WOMEN: We do not recommend FearFest-Evil if you are pregnant. There are uneven, muddy floors and unexpected frights and scares.

HEART CONDITIONS: If you have an existing heart condition, or are concerned about your heart health, then we do not advise you to attend FearFest-Evil

DIABETES: Please ensure you have enough medication on your person and you are able to walk and stand for long periods. If you have doubts about your health and fitness levels then we advise you not to attend FearFest-Evil

ASTHMA:  Please ensure you have your Asthma pump with you if you’re visiting the FearFest-Evil attraction. We use smoke machines as part of our special effects.  If in doubt, please consult your doctor before booking tickets.

STROBE LIGHTING/SPECIAL EFFECTS: Please note that FearFest-Evil is a high intensity event featuring strobe/flashing lighting, smoke machines, loud bangs and noises and electrical effects that can affect pacemakers, other implanted medical devices and those prone to seizures.

UNDER MEDICAL TREATMENT/OTHER DISABILITIES: This is an outdoor event which involves exposure to the elements, walking on uneven and muddy ground, in the dark and with sudden shocks and scares. If you are in doubt, please refrain from joining this event.

 Health Warning – If you are in any doubt, don’t participate in the Event.

  • ALCOHOL – If you appear intoxicated you cannot take part.Alcohol in moderation is permitted and may be purchased from the View Café Bar or Live Entertainment area. It cannot be taken into other areas of the FearFest-Evil Scare Zones.

If you are taking part in the

For the safety of the night creatures, customers and staff you may be refused entry if deemed to be adversely under the influence (No refund will be given).

If you are intoxicated you will be asked to leave the event (no refund will be issued).

  • No food or alcohol bought off-site is allowed to be brought to the venue.

  • FearFest-Evil Condemned is strictly open to persons aged 16+. Any individual who appears under the minimum age, will be asked for proof of age and will be asked to leave the event is they cannot adequately prove they are 16 or over.

  • Disclaimer consent must be completed for the Wire Zip Slide to comply with our insurance regulations.

  • Glasses and hard contact lenses can be worn.

  • Appropriate footwear must be worn.

  • Maximum weight limit is 120kg (18.8 stone) for the The Wire Zip Slide.

  • Lower Limit is 20kg (3.15 stone) for the The Wire Zip Slide.

  • Devices such as cameras, video cameras and mobile phones can be used in the Scare Zones providing they are used with sensitively to other participants, staff and actors. No flash photography in the Scare Zones.

  • Torches may NOT be used in the Scare Zones, as not to spoil the experience for other participants. They can however be used in other areas of the site.

  • No illegal substances, weapons, fireworks or other items which could harm you, or others, are allowed on site at any time.

Know Before You Go

At FearFest-Evil you’ll experience a whole new level of fear. Here are a few tips and advice to help you get out alive:

  • You will receive your booking confirmation via email. The email contains a PDF, you will be required to print a copy and bring with you to your event slot, as proof of purchase.
  • Be prepared that the night creatures will touch you, scare you, grab you, taunt you, capture you and even tie you up, they may blind fold you or separate you from your group or partner. If your really lucky you might get sprayed or covered in paranormal fluid, so be warned wear old clothes as they may get ruined. (all products and fluids used are skin safe, toxin and allergen free) Please be prepared for the night creatures to interact like never before and immerse you in the terror of the underworld. We cannot guarantee you will not be harmed due to the nature of the event. Do not book if you are not prepared for this.
  • Remember the safe word: "Condemned" for the night creatures to let you go in time.
  • The Night Creatures hate waiting for their victims so arrive promptly 1 hour before your intended scare zone entry You must arrive before 9.30pm otherwise we can not guarantee entry to the scare zones. If you are refused entry for arriving late you will not receive a refund, exchange or substitute of any kind.
  • For 2019 no time slots are being provided and we will be working to a queuing system. Please be prepared to wait and queue for admission.
  • Sturdy footwear and outdoor clothing appropriate to the time of year and weather conditions must be worn.
  • Wear old clothes as they could get damaged and we will not compensate for this in any way.
  • There will be enclosed spaces and tunnels. This will include a 90ft long underground sewer system, which for some sections you will need to crawl on your hands and knees.
  • Strobe lights will be in use throughout all Scare Zones.
  • There will be unpleasant and offensive smells!
  • The night creatures know what you are thinking and may try to separate your group, touch, grab, taunt, capture, tie you up or blindfold you, or cover you in paranormal fluid and smell you in preparation to feed you to the ancient evil.
  • This could get messy – you may get dirty, or covered in paranormal fluid Do not book if you are not prepared for this!

Site Rules & Restrictions

We have some information, rules and regulations to help you enjoy your visit to FearFest-Evil, they are as follows:

Restrictions and Behaviour

  • Under 16’s are not permitted to the FearFest-Evil Condemned event due to its adult nature and theme.
  • Costumes are encouraged! but not masks or face prosthetics. The undead need to see your fear and follow your footprints
  • Do not bring anything that could harm you or others onto the site. This includes drugs, weapons, fireworks, bottles, flashlights and laser pens onto the site.
  • Alcohol in moderation is permitted in the View Café Bar and the live entertainment area of the Water View Marquee. Alcohol cannot be taken into the other areas of the FearFest-Evil Scare Zones. If you are taking part in the Wire Zip Slide Slide you should not drink beforehand. For the safety of the night creatures, customers and staff you may be refused entry if deemed to be adversely under the influence.
  • You must arrive 1 hour before your intended time and before 9.30pm otherwise we cannot guarantee your entry.
  • No food or alcohol bought off-site is allowed to be brought to the venue.
  • Devices such as cameras, video cameras and mobile phones can be used in the Scare Zones providing they are used with sensitively to other participants, staff and actors. No flash photography and strictly no torches in the Scare Zones.
  • No disrespecting or touching of FearFest-Evil set, our performers or event staff. The creatures of the night are protective of their own and do not like inappropriate behaviour, physical or verbal retaliation or foul language – so be warned! You will be asked to leave with no refund, exchange or substitution or compensation of any kind.
  • Please respect our neighbours and show consideration for local residents whilst travelling to and from the site and taking part in activities at FearFest-Evil.
